Since long, various communities are debating over the issue of Triple talaq. It is practiced by Muslim males to get the divorce from their respective married partners. They only need to say ‘Talaq’ three times. For the last couple of days, this issue became so heated that PM Modi had to interfere. PM urged the people of different religions not to politicize the issue.

Today is the final hearing on this matter in the apex court. The bench comprises of five senior judges of Supreme Court of India. The bench will hear the arguments put forward by various communities on triple talaq practice of the Muslims. The unique part of this case is that the bench consists of judges from 5 different religions.

The names of 5 member bench are; Chief Justice JS Khehar (Sikh), Justice Kurian Joseph (Christian) and Justice Rohinton Nariman (Parsi). Other two members are Justice Uday Lalit (Hindu) and Justice Abdul Nazeer (Muslim). These all five belong to different castes and religions.

This bench will hear seven petitions on triple talaq along with the main petition named Quest for Equality vs. Jamiat Ulama-i-Hind.

Reportedly, the main petition is trailed by other six petitions. These are filed by Khuran Sunnath Society, Shayara Bano and Aafreen Rehman. Other three pleas are filed Gulshan Parveen, Ishrat Jahan and Atiya Sabri.

Besides the 5-member bench, attorney general Mukul Rohatgi is appointed to help the bench. He will assist the bench and inspect to what extent the court can obstruct in Muslim Personal Law Board. He will help the bench to take a balanced decision.

The SC will observe the issue very closely before giving any order on the legal validity of triple talaq. The top court is also to review the legal validity of polygamy practice, quite common among Muslims.

Today’s hearing in the apex court holds importance. Earlier, Allahabad High Court did not back this law. It called this practice unilateral and bad in law.  The high court verdict came when Aaqil Jamil’s wife filed the criminal case against him. She alleged that he tortured her as the demands for dowry were not met. After torturing, he had given her triple talaq.

The anti-triple talaq activists are hoping to hear positive news from the top court. A West Bengal activist group under the banner of Join Movement Committee is confident enough to get the decision in their favor. Since long, this group is campaigning to ban this practice.

Whatever decision comes from the Court but this practice is really bad. This must be stopped.
